New “Food Safety” Law in Azerbaijan: what do you need to know
5 May 2022-ci il tarixdə qəbul edilmiş yeni Qida Təhlükəsizliyi haqqında Qanun Azərbaycanda istehal və emal edilmiş, eləcə də Azərbaycan Respublikasına idxal edilmiş qida məhsullarının emalı, dövriyyəsi və məhv edilməsi məqslədləri üçün hüquqi və təşkilati əsaslar yaratmışdır. Qanun 1 Yanavar 2023-cü ildə qanuni qüvvəyə minir. Buna baxmayaraq, müxtəlif tətbiq sahələri nəzərə alınmaqla, Qanunun bəzi müddəaları sonrakı illərdə qüvvəyə minəcəkdir.

Yeni Qanun aşağıdakılar daxil olmaqla, lakin bunlarla məhdudlaşmadan, geniş sahələri əhatə edir:
The new “Food Safety” Law enacted on May 5, 2022 established the legal and organizational basis for production, processing, circulation, utilization and destruction of food and feed products produced in or imported to the territory of the Republic of Azerbaijan. The Law comes into effect as of Jan 1, 2023; however, some sections of the Law, depending on the area of regulation, will come into effect in subsequent years.


The new Law is designated to regulate, inter alia, a wide area covering:

  • qida və yem məsulları;
  • içməli (qablaşdırılmış) sular;
  • qida əlavələri;
  • genetik modifikasiya olunmuş orqanizmlər;
  • etiketlənmə qaydaları;
  • qida ilə təmasda olan material və məmulatlar;
  • qida məhsullarının saxlanma və nəqliyyat qaydaları;
  • qida məhsullarının istehlak olunduğu ictimai iaşə və xidmət obyektlərinə dair standart tələblər;
  • idxal və ixrac üçün tələblər (qida məhsularının idxalatçıları bundan sonra idxaldan qabaq müvafiq dövlət orqanlarına elektron bildiriş göndərməlidirlər və bunun edilməməsi inzibati məsuliyyətə səbəb olur);
  • “Qida Təhlükəsizliyi Reyestrinə” daxil edilməli olan qida məhsullarının növləri və
  •  qida məhsullarının sertifikasiya qaydaları.

  • food;
  • feed products;
  • potable water;
  • food supplements;
  • genetically modified organisms;
  • labelling of food products;
  • materials and products in contact with food;
  • acceptable conditions for food storage and transportation;
  • standard requirements for food production facilities;
  • requirements for import and export of food products (e.g. importers will be now required to send electronic notices to state authorities prior to importation where failure to do so will result in an administrative penalty);
  • food products to be included into the “Food Safety Registry”; and
  • food products’ certification procedure.
