Pursuant to the Law of the Republic of Azerbaijan No. 768-VIQD dated December 27, 2022, On Amending the Telecommunication Law, the actors involved in telecommunications have been expanded. Thus, unlike the previous regulation, not
solely the state authorities using telecommunication services, but state authorities (institutions) using
telecommunication services and radio frequencies will be considered subjects of telecommunication activities.
In addition, as a result of the changes, the radio frequencies will be allocated for a period of 10 years in accordance with the law On Telecommunication, as well as the law On Licenses and Permits.
Furthermore, additional circumstances have been determined for the cancellation of decision on the allocation of radio frequencies. Herewith, (i) in the case the license issued for the provision of telecommunication services is canceled, including when the license issued for cellular (mobile) telecommunication services expires, (ii) if the user of the radio frequency does not conclude the agreement on the use of radio frequencies with Ministry of Digital Development and Transportation
within 1 month after the decision on the allocation of radio frequencies, (iii) if the obligations contained in the concluded agreement on the use of radio frequencies are not fulfilled by the radio frequency
user, including if payments are not made in full within 2 years in accordance with the current tariffs for frequency nominals, and if the allocated radio frequencies are not used within 3 months, the decision on the allocation of radio frequencies shall be canceled.
Finally, according to the changes, certain prohibitions have been imposed on conducting radio surveillance and radio control by the law.
Accordingly, (i) design, installation, and operation
of radio electronic equipment using radio frequencies without a decision on the allocation of radio frequencies, as well as (ii) the installation and operation of radio electronic devices without a permit for the use of radio electronic devices, as well as acquisition and importation of radio receiver devices with wide frequency range and radio transmitters exceeding the relevant power criteria for
conducting radio surveillance and radio control without a special permit shall be prohibited.
